These Terms and Conditions ("Terms") apply to all products and services offered on the WizzGift website www.wizzgift.com and Android mobile application ("Application", "App").

Please carefully read these Terms, as well as our Privacy Policy, before proceeding, as they establish the contractual agreement between you (the "User") and us (‘WizzGift’).

By using WizzGift, such as browsing the website, purchasing products, registering a User Account, or participating in our Loyalty Program, you acknowledge that you have read and agree to the Terms, as well as the Privacy Policy. If you do not agree with both these Terms and the Privacy Policy, you are not permitted to use WizzGift Services, and you must immediately leave this website and/or uninstall our App.

1. Introduction

1.0.1 These Terms, which may be amended from time to time, apply to all WizzGift services made available online, through any mobile device, by email, or by telephone, whether directly or indirectly (through third-party distributors).

1.0.2 By accessing, browsing, and using our (mobile) website or any of our applications through any platform and/or purchasing products, registering a User Account, or participating in the Loyalty Program, you acknowledge and agree to have read, understood, and agreed to the terms and conditions outlined below, including our privacy statement.

1.0.3 This website www.wizzgift.com, including its pages, content, infrastructure, and the services provided by us on these pages and through the website and mobile application, are owned, operated, and provided by WizzGift LLC. They are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.

2. Definitions

2.0.1 The following terms or expressions used in these terms and conditions are defined as follows, unless the context specifies otherwise:

  • Application Form: The electronic form containing personal identification data and other user information to be submitted by the End User to the Company in order to register a User Account.
  • WizzGift, Company, We, or Us: Refers to WizzGift, a limited liability company incorporated under the laws of The United States.
  • Customer Care: The service unit fully authorized by the Company to provide a range of services supporting users with any issues related to the Service, receiving feedback, complaints, as well as ideas for improving WizzGift's service or security.
  • Digital Currency: Any cryptocurrency or digital cash accepted by WizzGift as a means of payment for the products purchased by the User.
  • End User, User, or You: Refers to any mobile, web, or app user accessing the WizzGift website or mobile application either directly or through third-party distributors. An End User may also be a Registered User.
  • Enrollment Date: The date the Application Form of the eligible applicant is submitted to the Company via the WizzGift Internet, mobile phone, or e-mail applications.
  • Enrollment: The process through which End Users who are not Registered Users yet request to become Registered Users and accept the Terms and Privacy Policy.
  • Issuer: The creator, designer, issuer, organizer, beneficiary, or manager of the Product.
  • Level: The type of Registered User and related privileges that the Registered User has access to, in accordance with the Terms and the rules and procedures set forth in the Loyalty Program Communication. Levels are generally obtained by Registered Users once a certain threshold of Points is earned within a specific time frame or through other specified procedures in the Loyalty Program Communication.
  • Loyalty Program Communication: The collective name for the means of communication used in the Loyalty Program, made through the WizzGift website and mobile site, mobile and desktop apps, brochures, emails and newsletters, enrollment forms, own social media accounts, and any authorized communication and promotions made by third parties.
  • Loyalty Program: The WizzGift loyalty program offered by the Company, introduced in 2020, developed to reward Registered Users who frequently use and/or purchase goods and services from the WizzGift website or App or in some way support WizzGift marketing efforts.
  • Overview: A summary of information regarding a Registered User's activity, typically including transaction history, balance of earned Points, and accumulation and spending history of Points.
  • Partners: Third-party companies with whom WizzGift has a direct contractual relationship, including product suppliers and technical service providers.
  • Platform: Collectively refers to the website www.WizzGift.com, including its pages, content, infrastructure, and the services provided by the Company on these pages and through the website and mobile application.
  • Points: The basic measuring unit used in the Loyalty Program. Points are earned on the WizzGift Platform by making purchases or according to other procedures specified in the Loyalty Program Communication. Registered Users can earn and accumulate Points to obtain Levels and redeem Rewards. Points may also be earned through procedures set forth by Accumulation Partners.
  • Privileges: Special services that may be offered to Registered Users by the Company once they reach a certain Level. Privileges may include discounts and other rewards based on Level.
  • Product or Products: Refers to any product/s available for purchase on the WizzGift website and mobile application.
  • Product Catalogue: The collection of Products available for purchase on the WizzGift website and mobile application.
  • Promotional Offers: Special temporary offers that provide Registered Users with opportunities to earn extra Points, use a reduced number of Points when ordering Rewards, or access additional benefits. Promotional Offers may also apply to non-Registered Users to incentivize them to register for the Service.
  • Registered User: An eligible End User who has successfully completed the Enrollment process by submitting their Enrollment Form, accepting the Terms, and receiving a Registration Number after the Company accepts their application. Only Registered Users are entitled to benefit from the Loyalty Program.
  • Retroclaim: The process through which a Registered User may claim Points earned before the Enrollment Date or Points accidentally unclaimed or un-awarded, as provided within the Terms
  • Reward: A gift obtained within the Loyalty Program by redeeming Points, following the Terms and procedures set forth in the Loyalty Program Communication. Rewards may include amounts of Digital Currency, digital gift cards, and other rewards.
  • Rewards Catalogue: A catalog of Rewards available to Registered Users, as communicated through the Loyalty Program Communication and in accordance with the Terms.
  • Service or Services: Refers to the services offered by WizzGift to the User for the purchase of Products on the WizzGift website and mobile application, in accordance with these Terms.
  • Supplier: Any company from which the Company procures Products available in the Product Catalogue, to be sold to End Users or made available in the Rewards Catalogue in exchange for Points.
  • Terms: Refers to the terms and conditions of this agreement that govern the relationship between the User and WizzGift. Unless expressly specified otherwise, "Terms" includes the Privacy Policy.
  • User Account or Account: A record associated with a unique identifier linked to a Registered User, containing various information collected during Enrollment or subsequently modified by the Registered User. It also includes a ledger of the collection and spending of Points performed by the Registered User, as well as other data such as transaction history.
  • Wallet Address: A unique identifier serving as a virtual location where the cryptocurrency can be sent and received.

3. The Service

3.0.1 WizzGift offers an e-commerce service platform specializing in the resale of Products (closed-loop gift cards, vouchers, and phone top-ups) of fixed or variable amounts, in different currencies. These Products can be purchased by the User with Digital Currency and redeemed by the User with a third party in exchange for services and products offered by such third party.

3.0.2 The Product Catalogue is organized on the Platform to display the available products for redemption in specific countries or regions. The User can select the desired product(s) by choosing the brand of the Issuer and selecting the amount in the local currency of the product(s). The local currency amount is either (i) selected from a predetermined list of amounts that cannot be changed by the User or (ii) freely defined by the User.

3.0.3 Users will provide an email address to which the Company will send the requested product. For Mobile Top-up Products, Users must also provide the exact MSISDN (mobile phone number) on which they intend to receive the mobile credit.

3.0.4 The User pays for the Product(s) by sending the requested amount of Digital Currency to the exact Wallet Address provided by WizzGift on the payment page of the website or mobile application.

3.0.5 In order for the payment to be valid, all of the following conditions must be met:

  • WizzGift must receive at least the exact amount requested in the payment page in the wallet address displayed.
  • The payment must be initiated by the User within 15 minutes from opening the payment page.

3.0.6 The number of blockchain confirmations necessary to determine the validity of the transaction ranges between zero and six, at the discretion of WizzGift based on its commercial, risk, and security policies.

3.0.7 Depending on the Product, the User may redeem the Product immediately with the relevant Issuer through WizzGift, in which case a written notification of redemption will be provided. Alternatively, the User may receive the Product onscreen, by email, or via SMS for independent redemption at a later stage.

3.1 Business to Consumer

3.1.1 WizzGift Services are provided to the User for personal, non-commercial (B2C) use only, establishing a Business to Consumer relationship between WizzGift and the User. If a business wishes to purchase Products from WizzGift or enter into any other agreement, it must first enter into a separate B2B agreement with WizzGift.

3.1.2 Products purchased through WizzGift may not be resold and shall be redeemed only by the User, on the User's behalf, or by someone to whom the User has gifted the Product/s.

3.2 Product Availability & Refunds Policy

3.2.1 WizzGift provides its services through a network of third-party service providers (Partners).

3.2.2 Transactions may fail due to technical or other reasons. WizzGift is not liable for technical issues affecting transactions. Users may qualify for a refund in case of transaction failure.

3.2.3 A transaction is considered failed if the User did not receive the Product, the Product cannot be redeemed due to prior redemption, or the Product is not a valid code. Upon contact from the User, WizzGift will investigate the issue and issue a refund if no fraud or foul play is detected.

3.2.4 WizzGift will not refund Users in cases where the User does not comply with the terms or policies of the Issuer, provides wrong contact or delivery information, or violates these Terms.

3.2.5 Determining the eligibility for a refund can be complicated and may take time. WizzGift reserves the right to investigate the issue for up to 2 weeks. Cooperation from the User expedites the refund process.

3.2.6 Refunds are made by WizzGift with a return transaction in the same Digital Currency to the User's provided Wallet Address. Users may also choose to receive the initially requested Product or an alternative Product instead of a refund.

3.2.7 Partial Payments occur when Users send an insufficient amount of Digital Currency. Users will be notified and given the option to send the missing amount or receive a refund for the entire amount.

3.2.8 Fraudulent attempts to obtain Products or refunds are considered criminal offenses and will be reported to the relevant authorities.

3.2.9 Once a Product is received, no refunds or reimbursements will be offered.

3.2.10 Refund requests must be made within 30 days from the transaction date. Users should contact info@WizzGift.com for refund requests or further information.

3.3 User Accounts

3.3.1 WizzGift offers eligible users the option to register a User Account. Users may submit one Application Form and have only one User Account associated with their legal name and a valid email address.

3.3.2 Duplicate accounts may be canceled by the Company, along with any benefits related to those accounts.

3.3.3 User Accounts cannot be transferred, bequeathed, assigned, sold, or combined with any other person's account, except as provided by the Company.

3.3.4 Registered Users are responsible for the usage of their Passwords and should not disclose them to third parties.

3.3.5 By registering an account on WizzGift, Users are deemed to have read and accepted these Terms and the Privacy Policy.

3.4 Loyalty Program

3.4.1 Registered Users become part of the Loyalty Program and must comply with the Program rules to accumulate Points and redeem Rewards.

3.4.2 Points accumulated prior to becoming a Registered User can be retroactively claimed as per the Retroclaim rules within the defined timeframe.

3.4.3 Registered Users accept receiving Loyalty Program Communications, with the WizzGift website or App being the main communication channels.

3.4.4 The Company reserves the right to refuse Registered Users' participation in the Loyalty Program if requirements are not met or if fraudulent or illegal behavior is suspected.

3.4.5 Levels, Privileges, and Points must be earned and used according to the Program's procedures and guidelines. WizzGift has the final say in determining whether Points have been earned by a Registered User.

3.4.6 Points will not be issued for forfeited, fraudulent, lost, out-of-date, or refunded transactions deemed unsuitable by WizzGift.

3.4.7 Loss, theft, or damage to the User Account must be reported immediately to Customer Care.

3.4.8 Sale, purchase, brokerage, resale, barter, or exchange of Levels and Points for compensation is prohibited, except as authorized by WizzGift. Violators may be liable for damages and litigation costs.

3.4.9 Program abuse or breach of the Terms may result in cancellation of the Registered User's account, disqualification from the Loyalty Program, forfeiture of Levels, Points, and previously issued but unused Rewards.

3.4.10 Points are earned by Users according to WizzGift's marketing and reward policies. Users are not entitled to claim Points unless they have been communicated as rewards for specific actions or transactions.

3.4.11 Points are frozen upon accumulation and can only be unfrozen for utilization once the freezing period determined by WizzGift has passed.

3.4.12 Frozen Points may be removed from the Registered User's Account in case of issuance issues.

3.4.13 Points are not earned for refunded transactions.

3.4.14 Retroclaims allow unregistered Users to earn and accumulate Points, which can be added to a Registered User's Account if association is possible. Anonymous Accounts and unregistered Users have no rights over accumulated Points.

3.4.15 Points collected by Registered Users expire at the end of the first full calendar year following their issue. Retroclaimed Points expire at the end of the third full calendar year following their anonymous issue.

3.4.16 Registered Users should verify that Points have been duly credited to their accounts.

3.4.17 The Company reserves the right to debit the account of any Registered User who has acquired Points unduly.

3.4.18 Only Partners with active accumulation agreements with WizzGift allow Points accumulation. Unauthorized accumulation attempts will not be credited to Registered Users.

3.4.19 Points are not earned in case of purchase refunds or undelivered Products. Any Points earned in unsuccessful transactions will be canceled.

3.4.20 All Points, Levels, and Privileges must be earned and used according to the Terms.

3.4.21 Retaining necessary documents, such as receipts, is the responsibility of Registered Users to demonstrate uncredited Points, if any.

3.4 Redeeming Points for Rewards

3.4.22 When a Registered User has earned a sufficient number of Points, the Registered User may spend such Points to request a Reward through the Rewards Catalogue, following the procedures outlined in the Loyalty Program Communication. Points redemption by Registered Users follows the First In First Out (FIFO) method. This means that when a Registered User spends Points to collect a Reward, the oldest Points available in the Registered User Account will be used first, starting with the Points that have the largest time distance from the redemption date.

3.4.23 Only the Registered User is entitled to apply for a Reward. The Registered User may order a Reward for themselves or for any other designated person, subject to the Terms. Once the Reward application is processed, the Points required for the Reward are debited from the Registered User's account. In some cases, there may be delays in debiting the Points to accounts.

3.4.24 Lost, stolen, or expired Rewards will not be refundable, replaced, or extended.

3.4.25 Rewards displayed or promoted on the Rewards Catalogue or Loyalty Program Communication may sometimes be unavailable or out of stock. WizzGift has the right to add or remove Rewards at its sole discretion. Registered Users do not have the right to claim Rewards that are no longer available or out of stock, even if the Registered User has already requested the Reward. If a Reward is no longer available, the Registered User may choose to spend the Points on another available Reward or keep the Points for future use.

3.4.26 The method of delivery for Rewards depends on the type of Reward requested. Digital items such as coupons, e-gift cards, multimedia content, and Digital Currency will be delivered electronically via email or other digital transfer methods. Physical items will be shipped to the designated mailing address provided by the Registered User. WizzGift is not liable for any issues related to the shipping of physical Rewards, including customs inspections or import taxes imposed on the Registered User.

3.4.27 WizzGift will make its best efforts to deliver Rewards within the indicated delivery time as communicated by WizzGift at the time of the request. However, WizzGift will not be held liable if it is unable to deliver the requested Reward within the specified time.

3.4.28 Each Reward requested by Registered Users is tracked with a unique Reward identifier. The unique identifier will be communicated to the Registered User during the redemption procedure and displayed in the Overview section. This identifier can be used as a reference when contacting Customer Care regarding any issues with the delivery of the Reward.

3.4.29 WizzGift is not responsible for broken or stolen Rewards.

Levels & Privileges

3.4.30 WizzGift may define Levels and Privileges at its discretion for loyal Registered Users based on their accumulated Points.

3.4.31 Registered Users can use the Privileges associated with their respective Level throughout the Level's effective period. WizzGift reserves the right to modify or revoke certain Privileges. Registered Users cannot claim any modified or revoked Privileges.

3.4.32 Levels and Privileges are personal and cannot be transferred among Registered Users.

3.4.33 WizzGift is entitled to revoke Levels and Privileges at its discretion if it determines that a Registered User obtained Levels and Privileges in an inappropriate or fraudulent manner.

3.5 Customer Care

3.5.1 To resolve issues related to using the WizzGift Service, Users must contact Customer Care through the appropriate channels, which include completing the online contact form at www.WizzGift.com/contact-us, sending an email to info@crypotrefills.com, or starting a chat conversation on the WizzGift Facebook page at www.facebook.com/WizzGift. Public tweets, Facebook posts, Reddit, and other community posts are not considered valid Customer Care channels and will not initiate the issue resolution process handled by Customer Care.

3.5.2 Customer Care will make its best efforts to provide a first reply within 24 hours of contact, but the response time may vary depending on the nature of the issue and the volume of requests being processed.

4 Limitations of Use

4.0.1 In accordance with the Company's KYC (Know Your Customer) and AML/TF (Anti-Money Laundering/Terrorist Financing) policies, there are limitations on the amounts Users can spend on Products within specific time frames based on User Tiers. The Tiers and corresponding limits are as follows:

  • Tier 1 Users: Unregistered Users
    • Daily Limit: 2,000 Dollar
    • Monthly Limit: 5,000 Dollar
  • Tier 2 Users: Registered Users
    • Daily Limit: 5,000 Dollar
    • Monthly Limit: 10,000 Dollar (Maximum amount per single Purchase: 2,000 Dollar)
  • Tier 3 Users: Verified Registered Users
    • Limits for the value of a single purchase, daily amounts, and monthly amounts can be increased on a case-by-case basis. This requires a know-your-customer (KYC) procedure where the User provides WizzGift with a copy of a valid ID, proof of residence, and other necessary documents and information. The User must confirm that the provided information is true and accurate, in accordance with applicable laws, regulations, and WizzGift's AML/TF policy. By requesting Tier 3 verification, the Registered User authorizes WizzGift to conduct necessary investigations directly or through a third party to verify the User's identity and protect against financial crimes such as fraud and money laundering. If there are grounds to believe that any provided information is incorrect, false, outdated, or incomplete, WizzGift reserves the right to delete the relevant information, send a notice demanding correction, terminate services provided to the User, and disclose information to relevant authorities, such as Financial Investigation Units and Crime Prevention Authorities, as required by regulations. 4.0.2 Users are prohibited from creating or using more than one WizzGift Account or any other means to circumvent the Tier-based limitations. Any such activity is a breach of the Terms and may result in WizzGift suspending the Account(s) until further notice. Illegal circumvention of the Tier-based limitations may be reported to relevant authorities, such as Financial Investigation Units and Crime Prevention Authorities, as necessary under applicable laws, regulations, and WizzGift's AML/TF policies.

5 Intellectual Property

5.0.1 The design, service, content, texts, logos (including the WizzGift logo and the word WizzGift), and any proprietary software and technology developed by WizzGift are the exclusive property of WizzGift. They are protected by copyrights, trademarks, service marks, international treaties, and/or other intellectual proprietary rights and laws of the Netherlands and other countries.

5.0.2 These Terms do not grant the User any right, title, or interest in any intellectual property owned or licensed by WizzGift, including the Platform, Service, and WizzGift trademarks. These Terms do not create a direct relationship between the User and WizzGift, except as stated in these Terms.

5.0.3 The User grants WizzGift permission to use and incorporate their ideas or suggested improvements into the design, service, and platform without further compensation. All rights to patents, copyrights, trademarks, and trade secrets related to the Service or Platform, including any modifications, remain with WizzGift.

5.0.4 The User must not misappropriate the design or content of WizzGift or alter or deface it in any way. The User acknowledges that nothing on WizzGift grants a license with respect to the design or content, and any use by the User or a third party must be authorized in writing by WizzGift.

5.0.5 Logos and trademarks used to represent third-party providers or the Products belong to the respective owners or holders of the rights. WizzGift uses these logos and trademarks solely to identify the Product or the Issuer. WizzGift does not claim or represent any ownership, license, authorization, partnership, or agreement with the owners or holders of such logos or trademarks, the Products, or the Issuers. The logos and trademarks of the Products belong to their lawful owners and are used by WizzGift solely for the purpose of identifying the Issuer or the intended use of the Product on sale.

6 Disclaimers

6.0.1 WizzGift acts as a reseller of the Products, having concluded agreements with wholesalers to purchase Products from Suppliers in its own name. WizzGift sells the Products in its own name to Users. WizzGift is not the owner or beneficiary of the Product and is not involved in determining the terms and conditions or any commercial or antifraud policy of the Product. WizzGift is not liable for any issues, damages, or losses arising from the terms and conditions set by the Issuer of each Product.

6.0.2 Unless expressly mentioned, WizzGift is not sponsored by any Issuer, nor is it related or acting on behalf or under the express authorization of any Issuer.

6.0.3 By purchasing the Product, the User enters into a contractual relationship with the Issuer. WizzGift is a third party in this relationship, and the contractual defenses and rights between the User and Issuer do not apply to WizzGift.

6.0.4 Before making a purchase on WizzGift, the User is responsible for conducting adequate due diligence on the terms and conditions of the Product being acquired, including its usability, limitations, and enforcement against the Issuer. WizzGift will not accept any claims related to such matters. The terms and conditions defined by the Issuer in relation to the Product govern the acquired Product. WizzGift is not liable for any decision or policy of the Issuer to refuse the Product based on the terms and conditions.

6.0.5 WizzGift makes no representation regarding the suitability of the Product for its intended use and does not provide any guarantees, warranties, or representations in respect of the Product.

6.1 Responsibility of the User

6.1.1 The User is fully liable for any mistakes, losses, or damages arising from providing incorrect, inaccurate, or fake information or from acquiring, reselling, using, or engaging in related activities with the Product or the Loyalty Program in a manner that violates applicable laws, regulations, contractual terms and conditions, or other agreements.

6.1.2 The Customer is solely responsible for the accuracy and correctness of the information provided on the platform or to WizzGift via email or through Customer Care. WizzGift is not liable for any consequences arising from the inaccuracy of the information provided by the Customer, such as providing the wrong phone number or email address resulting in not receiving the purchased Product or providing the wrong wallet address resulting in not receiving a refund.

6.1.3 Registered Users are responsible for maintaining the confidentiality of their password and account and for any activities and transactions that occur under their account. WizzGift is not liable for any loss or damage arising from a failure to protect the password or account.

6.1.4 Registered Users or beneficiaries of Rewards or Privileges are responsible for paying all applicable taxes, fees, levies, and/or surcharges associated with the issue or use of a Reward or Privilege. They must adhere to any legally or otherwise required country-specific regulations and check the customs formalities in force in the destination country before redeeming a Reward.

6.2 Unlawful Use

6.2.1 The WizzGift Services, Platform, Loyalty Program, and any Products purchased from WizzGift must not be used to infringe or circumvent applicable laws and regulations.

6.2.2 WizzGift will restrict User access, terminate Registered User Accounts, and report to relevant authorities any User activities, including Account data and purchase history, if WizzGift becomes aware or reasonably suspects that a User is conducting unlawful activities or breaking applicable laws, regulations, or third-party rights.

6.2.3 Users accessing WizzGift do so at their own initiative and are responsible for compliance with all local laws and regulations. If it is illegal or prohibited in the User's country of origin to access or use WizzGift or to buy or use any of the Products, the User shall not do so and is in breach of these Terms.

6.3 Limitation of Liability

6.3.1 WizzGift is not responsible or liable to the User, Issuers, or any third party for any loss or damage arising from the use of the Service or Platform or any Data accessed through the Platform or Software. This includes special, incidental, exemplary, punitive, direct, indirect, or consequential damages, such as loss of profit or revenue, injury to person or property, business interruption, or loss of business or personal information, even if WizzGift has been advised of the possibility of such damages. This limitation applies regardless of any failure of essential purpose or any limited remedy, to the fullest extent permitted by law.

6.3.2 In jurisdictions where the ability to disclaim liability is limited, WizzGift's liability shall be limited to the greatest extent permitted by applicable law.

6.3.3 No members of the WizzGift team (including employees, contractors, directors, management members, and other collaborators) have any liability in relation to the use of or reliance upon WizzGift or the Products purchased by Users.

6.3.4 WizzGift is not liable to any person for any loss or damage arising from the use of the information contained in any materials of WizzGift.

.3.5** WizzGift accepts no responsibility for viruses, malware, or other malicious or damaging software on User's devices.

6.3.6 Third-party content: The WizzGift Service, including its website and application, may include links to third-party websites or third-party plug-ins and applications. WizzGift has no control over these third parties or the content, products, services, and technologies they offer. Therefore, WizzGift does not accept any responsibility for third-party sites available through WizzGift via hyperlink, including their respective contents, hyperlinks, or security flaws. Any access to or use of a third-party site is solely at the User's own risk. Likewise, WizzGift does not accept any responsibility for third-party technologies used within the WizzGift Platform.

7 Personal Data Protection and Privacy

7.0.1 The Privacy Policy of WizzGift defines how User data is collected, processed, accessed, stored, and deleted.

7.0.2 Users must visit and review the Privacy Policy. If a User does not agree or consent to the Privacy Policy, they should not proceed with using WizzGift. Unregistered Users must provide explicit consent to the Privacy Policy for each Purchase they make on the WizzGift website or application. Users are required to accept the Privacy Policy when applying for a Registered Account.

8 Miscellaneous

8.1 Amendments to the Terms

8.1.1 WizzGift reserves the right to amend these Terms at any time without prior and/or public notice. Users should refer to the provided hyperlink before browsing the WizzGift website or application and before completing any purchase.

8.2 Jurisdiction

8.2.1 These Terms are governed by and construed in accordance with the laws of the Netherlands. The User agrees to submit to the jurisdiction of the Netherlands courts to settle any disputes arising in connection with these Terms.

8.3 Enforceability

8.3.1 If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be deemed severed from the remainder of these Terms. It will be replaced with a valid and enforceable provision that is as similar in intent as reasonably possible to the severed provision. The invalidity or unenforceability of one provision does not affect the validity or enforceability of the remaining Terms.

8.4 Entire Agreement

8.4.1 These Terms, together with the Privacy Policy, constitute the entire agreement between the User and WizzGift regarding the subject matter. They supersede all prior agreements relating to the subject matter.
